Chapter 18 - Vanessa Takes the StandVanessa's attorneys made a risky decision.

She testified.
Daniel was stunned.
Caroline was not.
“She thinks she can explain herself.”
“Can she?”
“We'll find out.”
Vanessa walked to the witness stand.
Her attorney began gently.
“Did you push Nora into the pool?”
“No.”
“Did you try to kill her?”
“No.”
“Did you remove the ladder that afternoon?”
Vanessa hesitated.
“Yes.”
A murmur moved through the courtroom.
Daniel stared.
Her attorney continued.
“Why?”
“It had been loose. I had asked about removing it before.”
That explained the pool technician.
“Why did you move it while Nora was outside?”
“I didn't know she was in the pool.”
“What about the security camera?”
“I disabled it because it had been sending repeated motion alerts.”
“Why did you tell police you hadn't been near the pool?”
“I panicked.”
“What about the financial questions concerning Nora's death?”
Vanessa breathed slowly.
“I was trying to understand my husband's estate.”
“Why?”
“Because Daniel refused to discuss money with me.”
Daniel almost laughed.
The strategy was clear.
Every fact had an explanation.
Individually possible.
Together absurd.
Then Vanessa's attorney addressed the fraud.
She admitted knowing about some unauthorized transfers.
She blamed Marcus for the scale.
“I made terrible financial decisions.”
Her voice broke.
“But stealing money does not make me a murderer.”
That was true.
Caroline would have to connect the two.
On cross-examination she approached slowly.
“Mrs. Mercer, you said the ladder was loose.”
“Yes.”
“Did you tell Daniel?”
“No.”
“House staff?”
“No.”
“Pool service?”
“No.”
“Did you leave a warning?”
“No.”
“Where did you place the ladder?”
“Behind the pool house.”
“Out of sight?”
“I didn't think about it.”
Caroline displayed the patio timeline.
“You walked toward the pool with Nora at 2:12?”
“Yes.”
“You returned without her at 2:20?”
“Yes.”
“Where did Nora go?”
“I don't know.”
“She was three.”
“Yes.”
“You were responsible for her.”
Vanessa's voice tightened.
“I thought she went inside.”
“No camera shows her going inside.”
“I can't explain every camera angle.”
Caroline paused.
“Did you hear her cry?”
“No.”
“Did you hear Milo bark?”
“Yes.”
“Why did you tell him to get away?”
“He was jumping on me.”
“While you were removing the ladder?”
“Yes.”
“So Milo was near you when you removed it?”
“Yes.”
“And Nora was somehow already missing?”
“I didn't know she was missing.”
Caroline allowed the silence to grow.
Then she played the encrypted voice note with Marcus.
“I'm not asking you to do anything to Nora.”
Marcus:
“Then stop asking me what happens if she's dead.”
Vanessa stared forward.
Caroline stopped the recording.
“Why was Marcus concerned?”
“He misunderstood.”
“Repeatedly?”
“Yes.”
“Why did you ask what you would inherit if something happened to Daniel?”
“Estate planning.”
“Why did you label a file ‘After D’?”
“My husband is Daniel.”
“So D was Daniel?”
Vanessa froze.
Her attorney objected.
Too late.
The jury had heard it.
Caroline nodded.
“And N?”
Vanessa realized the trap.
“I don't remember.”
“Was N Nora?”
“I don't remember.”
“You remember D but not N?”
“I said I don't remember.”
Caroline walked back to the table.
Then turned.
“When Daniel found Nora alive in the pool, were you relieved?”
“Yes.”
“Immediately?”
“Yes.”
“Then why did Daniel describe your expression as shock?”
“He was emotional.”
“Why did Nora say you pushed her?”
“She was confused.”
“Why did she say you told her ‘Rest in peace’?”
“I don't know.”
“Why did you ask whether a child could climb out without the ladder?”
“Safety.”
“Why did you learn how to remove it?”
“Maintenance.”
“Why did you disable the camera?”
“Alerts.”
“Why did you lie to police?”
“Panic.”
“Why did you ask what happens if Nora dies?”
“Estate planning.”
Caroline stopped.
Five explanations.
Each technically possible.
Together horrifying.
She looked at the jury.
Then back at Vanessa.
“Mrs. Mercer, how many coincidences does one afternoon require?”
Defense objected.
Sustained.
May you like
Caroline sat.
But the question had already landed.
