Chapter 21 - The HearingThe courthouse smelled of old wood, paper, and rain-soaked winter coats.

Nathan arrived shortly before nine on Monday morning, November sixteenth.

He wore a dark suit but no tie.

Margaret walked beside him.

Evelyn was already speaking with counsel near the courtroom entrance.

Across the corridor, Vivian stood with two attorneys. Colin sat several feet away beside his own lawyer.

That separation told Nathan something.

The partnership was beginning to fracture.

Vivian saw him.

For a moment, her expression softened.

“Nathan.”

He stopped.

She approached, but Margaret stepped slightly closer to her brother.

Vivian noticed.

“You're really going to let them do this?” she asked.

Nathan looked at her.

“Do what?”

“Destroy everything we've built.”

He felt an old instinct to reassure her.

It passed.

“You helped build a problem,” he said. “Now people are trying to stop it from becoming worse.”

Vivian's eyes filled with tears.

“You used to believe in me.”

“I did.”

The simplicity of his answer seemed to wound her.

Then her attorney touched her elbow, and she returned to the other side of the corridor.

Inside, the judge began by clarifying the limited issue before the court.

This was not a criminal trial.

The court would not determine whether Vivian had committed financial fraud or whether Nathan had been a good husband.

The immediate question concerned disputed contractual rights and whether temporary relief was justified to prevent potentially irreparable harm while the parties litigated.

Evelyn's attorney presented the ownership structure.

Owen's trust held sixty percent of Ashford Property LLC.

Nathan's holding company held forty percent.

Certain agreements required consent before major property-related transactions.

The challenged financing involved disputed authorizations, undisclosed related-party interests, and enforcement provisions potentially affecting ownership and operating arrangements.

The attorney described the restoration reserve transfers.

The missing services.

The Rosecross structure.

The alleged use of Nathan's electronic credentials without authorization.

Then Cora Patel testified about the financial records.

She was careful.

She did not declare that every transaction was fraudulent.

She explained where funds moved and how the entities were connected.

Rosecross's lawyer challenged her conclusions.

“Isn't it possible these transfers reflect legitimate commercial investment activity?”

“It's possible for related-party investments to be legitimate,” Cora replied. “But the records I've reviewed contain material disclosure and documentation deficiencies.”

“You cannot establish criminal intent.”

“I'm not offering a criminal-intent opinion.”

Nathan watched her.

He began to understand why Evelyn trusted her.

She refused to be pulled beyond what the evidence supported.

Later, Rebecca explained the electronic authorization logs.

Nathan testified about his location on September twenty-ninth and his use of a shared household tablet.

His attorney had obtained the urgent-care records showing Owen's visit.

Under questioning, Nathan acknowledged that he had failed to secure his account properly.

He also acknowledged that he had allowed Vivian extensive access to company discussions.

Rosecross's attorney asked about the elevator incident.

“Mr. Whitcomb, didn't you recently strike a hotel employee during an emotional confrontation?”

“Yes.”

“Would you agree that your judgment was impaired that morning?”

“My judgment was wrong that morning.”

“And wouldn't the company have reason to question your judgment in other matters?”

Nathan paused.

“Of course the company has reason to examine my decisions.”

The attorney appeared pleased.

Then Nathan continued.

“But a mistake I admit doesn't make signatures I didn't authorize valid. The court should decide those questions from the documents.”

Margaret lowered her head, hiding an expression that looked almost like relief.

She had spent weeks fearing her brother would continue defending himself by denying the obvious.

He wasn't doing that anymore.

Vivian's attorneys argued that the financing was commercially necessary and that the property-related concerns had been overstated.

They emphasized that Owen's trust did not directly guarantee the operating company's loan.

Evelyn's counsel acknowledged that point.

But he argued that the disputed enforcement provisions, management-contract transfers, and pledged ownership interests created a sufficiently serious risk to justify limited temporary relief.

The court recessed.

Nathan waited in the corridor.

His phone vibrated.

A message from Tessa Nguyen.

Ryan knows about today's hearing. He asked me to tell you that he hopes Owen's interests are protected.

Nathan read it twice.

He typed a response.

Please thank him. I haven't forgotten what I owe him.

The judge returned that afternoon.

The ruling was narrow but significant.

The court temporarily restrained specified disputed enforcement actions and transfers affecting the property-related interests pending a fuller evidentiary record.

It required preservation of relevant documents and maintained the status quo under defined conditions.

The judge emphasized that the ruling was not a final finding of fraud.

Other contractual obligations remained subject to litigation.

Evelyn closed her eyes briefly.

The hotel's ownership had not been taken from Owen.

Not that day.

Nathan felt the first genuine relief he had experienced in a month.

Across the room, Vivian sat motionless.

Colin whispered something to his lawyer.

Then the judge said another matter required attention.

The financial records included transfers that might warrant review by appropriate investigative authorities.

Those questions were not being resolved in this proceeding.

Nathan looked at Vivian.

She was no longer looking at him.

She was staring at the papers in front of her.

For the first time since the elevator incident, she appeared to understand that Nathan was not the only person she had to persuade.

And some people could not be manipulated with love.
